Attention All Providers: OSHA Vaccination and Testing Compliance Begins Today, January 10

​With the Occupational Safety and Health Administration (OSHA) withdrawing the Healthcare Emergency Temporary Standard (ETS), the OSHA Vaccination and Testing ETS now applies to all employers with 100 or more employees. This includes assisted living, skilled nursing facilities, and other long term and health care providers. AHCA/NCAL has developed a resource to assist providers in determining if their organization meets the 100-employee threshold. 

The OSHA Vaccination and Testing ETS includes an option for testing unvaccinated employees. Starting today, January 10, 2022, employers should start collecting COVID-19 vaccination status on all employees. By February 9, 2022, employers should be testing employees who are not fully vaccinated at least once every seven days. OSHA notes that it plans to work closely with employers to provide compliance assistance and has resources to assist employers. 

Oral arguments on the Vaccination and Testing ETS were heard before the U.S. Supreme Court this past Friday, January 7. AHCA/NCAL will keep members updated when the Supreme Court issues a judgement.
