AHCA updated this member alert from earlier this week to call out the regulatory relief related to COVID-19 requirements for nursing homes, specifically F885 and F888,​ from the CMS QSO-23-13-ALL memo.​

F885- Resident and Family Notifications  
AHCA received confirmation from CMS that the requirement at §483.80(g)(3) to notify all residents and their representatives about COVID-19 cases ended Monday, May 1, 2023, when the QSO was issued. ​Facilities are no longer required to notify all residents and their representatives when there is a positive COVID case in the facility, or if there have been three more residents with new onset of respiratory symptoms occurring within 72 hours of each other. Notification of changes in condition for residents will still apply as referenced in F580 at §483.10(g)(14). 

F888- Staff Vaccination Requirements​  
CMS will soon end the interim final rule requiring facilities to develop and implement policies and procedures to ensure that all staff are fully vaccinated for COVID-19. CMS has stated more detail will be shared regarding the end of this requirement §483.80(i) at the anticipated end of the public health emergency on May 11, 2023. AHCA will share any updated information as it is made available.
