Past Noncompliance is achieved when a facility can demonstrate to surveyors that a deficient practice existed but was identified and corrected before the survey began. In these situations, providers must show not only that corrective actions were implemented, but also that the concern no longer exists, and systems are in place to prevent recurrence.
Successfully demonstrating Past Noncompliance requires strong documentation, clear evidence of corrective action, and ongoing monitoring to support sustained compliance. Because this remains an important survey focus area, the AHCA Regulatory Team has developed several resources to help members better understand expectations and strengthen their approach.
