Temporary Protected Status Update

On August 20th, a federal appeals court allowed the Trump Administration to end temporary protections for approximately 60,000 migrants from Nicaragua, Honduras and Nepal. The decision by the 9th Circuit Court of Appeals overturns a lower court decision that blocked the Trump administration’s plans to end Temporary Protected Status (TPS).  The U.S. Department of Homeland Security reaction to the federal court decision can be found here. The Secretary of Homeland Security may designate a foreign country for TPS due to conditions in the country that temporarily prevent the country's nationals from returning safely or, in certain circumstances, where the country is unable to handle the return of its nationals adequately. United States Citizenship and Immigration Services (USCIS) may grant TPS to eligible nationals of certain countries (or parts of countries) who are already in the United States. Eligible individuals without nationality who last resided in the designated country may also be granted TPS.
