As noted in previous AHCA/NCAL communications, in September 2025, the Trump administration announced a policy requiring employers to pay a $100,000 fee for certain new H-1B visa petitions involving workers outside the United States. Recently, U.S. District Judge Leo Sorokin ruled that the $100,000 fee was unlawful and exceeded the authority granted to the executive branch. The court vacated the policy and blocked its enforcement.
The fee raised concerns among employers that the increased cost would create significant barriers to hiring qualified professionals from abroad. The administration is expected to consider an appeal. AHCA/NCAL will continue to monitor developments and provide updates as any additional information becomes available.
