As previously shared in
AHCA/NCAL communications, the Trump administration announced in September 2025 a policy requiring employers to pay a $100,000 fee for certain new H-1B visa petitions filed on behalf of workers located outside the United States.
On July 24, the U.S. Court of Appeals for the First Circuit denied the federal government's request to temporarily reinstate the fee while litigation challenging the policy continues. As a result, the district court's order vacating the policy remains in effect during the appeal process.
At this time, employers are not required to submit a $100,000 payment in connection with H-1B visa petitions.
